1. Sweepstakes Period: The Timber Wolf “Back Roads” Sweepstakes (the “Sweepstakes”) begins at 12:00:01 p.m. Eastern Time (“ET”) on March 16, 2009 and ends at 11:59:59 a.m. ET on September 30, 2009 (the “Sweepstakes Period”).
2. How To Enter: During the Sweepstakes Period, to receive an entry into the Sweepstakes, you may enter by: 1) visiting TWBACKROADS.com (the “Site”), clicking on the Sweepstakes link and completing all required registration information, including selecting the off-road vehicle you would like to win; 2) visiting participating select retailers and completing an entry form located on the back panel of the rewards catalog, including selecting the off-road vehicle you would like to win, and mailing it in a hand-addressed stamped envelope, to: Timber Wolf “Back Roads” Sweepstakes, P.O. Box 7862, Melville, NY 11775-7862. Mechanically reproduced mailed entries will not be accepted. Mail-in entries must be postmarked by September 30, 2009 and received by October 7, 2009. Limit one entry per person/email address per day regardless of method of entry. Online entries must be received by 11:59:59 a.m. ET on September 30, 2009. If entering online, normal Internet access and usage charges imposed by your on-line service will apply. All entries become property of Pinkerton Tobacco Co. LP (“Sponsor”).
3. Random Drawing: The winners will be selected in a random drawing on or about October 30, 2009, from among all eligible entries received. Random drawing will be conducted by Don Jagoda Associates, Inc., an independent judging organization whose decisions are final on all matters relating to this Sweepstakes. Odds of winning will depend upon the number of eligible entries received. All prizes will be awarded and winners will be notified by mail/email and/or phone.
4. Prizes And Manufacturer’s Suggested Retail Prices (“MSRP”): Grand Prizes (3 - one of each of the following prizes): 1) A 2009 Jeep Wrangler X 4-Door 4x4 S package with Sponsor-selected accessory additions (MSRP: $39,876); 2) A 2009 Polaris Sportsman XP 850 EFI with Sponsor-selected accessory additions (MSRP: $9,954); or 3) A 2009 Kawasaki Teryx 750 FI 4x4 LE RUV with Sponsor-selected accessory additions (MSRP: $12,867). Please note, MSRP’s include all Sponsor-selected accessories, which will be outlined in detail to winners, once they are confirmed. In the event that a 2009 model from the vehicles listed above is not available, a 2010 model will be awarded. Winner will receive the vehicle he/she selected at time of entry. In the event any vehicle listed above was not selected on any entries, a winner will be selected and that vehicle will be awarded to winner regardless of what vehicle was listed on his/her entry. Limit one prize per person/household. Prizes are nontransferable and winners may not substitute prizes. Sponsor reserves the right to substitute a prize of equal or greater value. Income and other taxes, if any, related to the prize are the winner’s sole responsibility.
5. Eligibility: Open to legal residents of, and currently residing in, the contiguous 48 United States and the District of Columbia (excluding residents of VA, MA & MI), who are 21 years of age and older as of date of entry. Employees of Sponsor and any of its affiliates, parents or subsidiaries, respective parent, subsidiary, and affiliate companies and advertising and promotion agencies, persons engaged in the development of Sweepstakes materials or events, and Don Jagoda Associates, Inc., and members of their immediate families (spouses, parents, children, and siblings and their spouses) living in the same household of each are not eligible. Groups, clubs, organizations, commercial entities and businesses cannot participate. Void where prohibited by law and subject to all federal, state and local laws.
6. General Rules: Grand Prize winners will be required to execute and return an affidavit of eligibility and liability/publicity release (where legal) within fourteen (14) days of notification attempt or prize will be forfeited and an alternate winner selected. Return of prize notification as undeliverable may result in disqualification and alternate selection. Winner is solely responsible for income and other taxes and all applicable vehicle insurance, licensing, registration and title fees, if applicable. Winner will be required to show proof of insurance and a valid driver’s license prior to taking delivery of the vehicle. Any additional and available vehicle options (excluding the Sponsor-selected accessory additions) that are not standard on make and model of vehicle listed in prize description are the sole expense of winner. If winner selects a color that is not standard on make/model of vehicle, that color would be at winner’s expense. Vehicle depicted in any advertising materials may be different, including accessories shown, from the vehicle awarded. Acceptance of prize constitutes permission to use winner’s name and likeness for promotional purposes without further compensation except where prohibited by law. By entering, entrant accepts and agrees to be bound by these Official Rules and the decisions of the judges. Winners and all entrants, as a condition of entry into the Sweepstakes, agree to release Sponsor, Don Jagoda Associates Inc., their respective parents, subsidiaries, affiliated companies, promotion agencies (“Administrators”) and each of their respective officers, directors, shareholders, members, employees, agents, assigns and all others associated with the development and execution of this Sweepstakes from and against any and all liability, claims or actions of any kind whatsoever for injuries, damages, or losses to persons or property which may be sustained in connection with submitting an entry or otherwise participating in any aspect of the Sweepstakes, the receipt, ownership or use of any prize awarded or any typographical or other error in these Official Rules or the announcement of offering of the prizes. In the event of a dispute as to the identity of an entrant entering via the online method of entry, the authorized account holder of the email address used to enter, will be deemed to be the entrant. “Authorized account holder” of an email address is defined as the natural person who is assigned to an email address by an Internet Access provider, on-line service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. Sponsor reserves the right at its sole discretion to disqualify any individual that tampers or attempts to tamper with the entry process or the operation of the Sweepstakes or the Site; violates the Official Rules; acts in an unsportsmanlike or disruptive manner: or acts with intent to annoy, abuse, threaten or harass any other person. Sponsor and its Administrators are not responsible for lost, late, illegible or postage due mailed entries or for technical, hardware or software malfunctions, telephone failures of any kind, lost or unavailable network connections, or failed, incorrect, inaccurate, incomplete, garbled or delayed electronic communications, whether caused by the sender, by any of the equipment or programming associated with or utilized in this Sweepstakes which may limit the ability to participate, or by any human error which may occur in the processing of the online entries in this Sweepstakes. Entries generated by script or bot are not eligible. Sponsor reserves the right to cancel, terminate or modify the online portion of the Sweepstakes if it cannot be completed as planned for any reason, including for infection by computer virus, bugs, tampering, unauthorized intervention, technical failures, or corruption of any sort. In such event, Sponsor will award prizes from among all eligible online entries and all eligible mail-in entries received. As a condition of entering the Sweepstakes, participant agrees that: 1) under no circumstance will participant be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental, consequential or any other damages, other than for out-of-pocket expenses; 2) all causes of action arising out of or connected with this Sweepstakes, or any prize awarded, shall be resolved individually, without resort to any form of class action; and 3) any and all claims, judgments, and award shall be limited to actual out-of-pocket costs incurred, but in no event attorneys fees.
